03 Orders & Acceptance

An order placed by phone, email or other accepted channel is an offer to purchase. The firm's acceptance occurs on confirmation or dispatch of the order; until then, the firm may decline or partially fulfil an order, including where stock or licence verification is not satisfied.

04 Pricing & Taxes

Aagam Drug House Private Limited sources Goods through legitimate supply channels and supplies them in their original manufacturer packaging. Product specifications, indications and warranties are those of the respective manufacturer; the firm acts as a distributor and supplier.

09 Limitation of Liability

To the extent permitted by law, the firm's liability in connection with any order is limited to the invoice value of that order. The firm is not liable for indirect or consequential loss, or for matters attributable to the manufacturer, the counterparty's handling, or events beyond reasonable control.

10 Governing Law & Jurisdiction

These terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction over any dispute, claim or proceeding arising out of or in connection with these terms or any transaction governed by them.

01 General Position

As a pharmaceutical distributor, Aagam Drug House Private Limited does not accept returns of correctly supplied Goods on grounds of changed buying preference or over-ordering. Returns are limited to the specific situations described below and are always subject to verification.

02 Eligible Returns

Returns may be considered where: (a) Goods were supplied in error against the confirmed order; (b) Goods were damaged in transit and the damage was recorded on the delivery document; (c) Goods were received with a manufacturing defect; or (d) a product recall has been initiated by the manufacturer or a competent authority.

03 Notification Window

Discrepancies and transit damage under heads (a) and (b) must be reported to the trade desk within three (3) working days of receipt, with supporting evidence and the original delivery document. Suspected manufacturing defects under head (c) should be reported promptly on discovery. Recalls under head (d) follow the timelines stated in the recall notice.

04 Conditions for Acceptance

Goods presented for return must be in their original manufacturer packaging, with intact batch and expiry details, not tampered with, decanted or relabelled, and accompanied by the relevant invoice reference. A return is accepted only after the firm issues a return authorisation.

05 Near-expiry & Expiry

Any near-expiry or expiry return is handled strictly in accordance with the policy of the relevant manufacturer and applicable regulation. The firm will guide trade partners on the manufacturer's expiry-return window and procedure where such a facility exists.

06 Credit Mechanism

Where a return is approved, the value is generally adjusted as a credit against the counterparty's account or future invoices. Any GST adjustment is processed through a credit note compliant with applicable tax rules. Timelines for manufacturer-linked returns depend on that manufacturer's processing.

07 Disputes & Jurisdiction

Any dispute regarding a return or credit should be raised in writing with the trade desk. Unresolved disputes are subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, and governed by Indian law.

On delivery, the counterparty's representative should verify parcel count and check for visible damage, and record any discrepancy on the delivery document before acknowledging receipt. Acceptance without such notation is treated as confirmation of correct delivery for the purposes of the Returns & Refunds policy.

06 Charges

Any delivery or freight charges, where applicable, are advised at the time of order acceptance and itemised on the tax invoice. Minimum-order conditions, if any, are communicated through the trade desk.

07 Failed or Refused Delivery

Where a delivery cannot be completed because the consignee is unavailable, refuses receipt, or the address is unserviceable, the Goods are returned to the firm and re-delivery may attract additional charges. Perishable or short-dated Goods are handled in accordance with regulation.
